Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Bluefin Software, LLC ("Bluefin Software," "Postlio," "we," "us," or "our"), a Michigan limited liability company. They govern your access to and use of Postlio's website and content automation platform (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be at least 16 years old and able to form a binding contract to use the Service. When you create an account, you agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

2. Description of the Service

Postlio helps you automate blog and content production by generating topic ideas, writing posts, creating images, and publishing approved content to platforms you connect, such as WordPress, Wix, Shopify, and Google Business Profile. Content is generated using third-party AI providers and is presented to you for review and approval before publishing.

3. Your Responsibility for Content

You are responsible for reviewing, editing, and approving all content before it is published. Because content is generated by AI, it may contain inaccuracies, errors, or material that requires revision. You agree that:

• You will review generated content for accuracy, quality, and compliance before approving it for publication;
• You are solely responsible for content you approve and publish through the Service;
• You will not use the Service to create or publish content that is unlawful, infringing, defamatory, misleading, or otherwise harmful;
• You have the necessary rights and permissions to publish content to your connected platforms.

4. Acceptable Use

You agree not to:

• Use the Service in violation of any applicable law or regulation;
• Infringe the intellectual property, privacy, or other rights of any third party;
• Generate spam, deceptive, or malicious content, or attempt to manipulate search rankings in violation of a platform's guidelines;
• Reverse engineer, interfere with, or disrupt the Service, or attempt to gain unauthorized access to it;
• Resell or provide the Service to third parties except as expressly permitted by your plan.

5. Connected Platforms

The Service integrates with third-party platforms through their APIs. Your use of those platforms is governed by their own terms and policies. You are responsible for maintaining valid credentials and permissions for any platform you connect, and we are not responsible for the availability, actions, or policies of third-party platforms.

6. Content Ownership

As between you and Postlio, you own the content you generate, approve, and publish through the Service, subject to the terms of the applicable AI providers. You grant Postlio a limited license to process, store, and transmit your content solely as needed to operate and provide the Service. Postlio retains all rights in the Service itself, including its software, design, and trademarks.

7. Plans, Trials, and Payment

Paid plans are billed on a recurring basis according to the plan you select. Free trials, where offered, convert to a paid subscription unless canceled before the trial ends. You authorize us to charge your payment method for applicable fees. Fees are non-refundable except where required by law. We may change our pricing with reasonable notice, and changes will take effect at your next billing cycle.

8. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period, and you will retain access to paid features until then. We may suspend or terminate your account if you violate these Terms or fail to pay applicable fees.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for your purposes.

10. Limitation of Liability

To the fullest extent permitted by law, Postlio and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Postlio and its affiliates from any claims, damages, liabilities, and expenses arising out of your content, your use of the Service, or your violation of these Terms or the rights of any third party.

12. Changes to the Service and Terms

We may modify or discontinue features of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Michigan, and you consent to personal jurisdiction and venue in those courts.
